Supreme Court Orders NIA Probe into Attack on Judicial Officers in West Bengal

The Supreme Court on Monday took serious note of a major security lapse in West Bengal and ordered the National Investigation Agency (NIA) to take over the investigation into the recent attack on judicial officers in Malda district.

The case relates to an incident on April 1, when seven judicial officers were allegedly surrounded (gheraoed) and held for nearly nine hours by a mob. The Court described the situation as a “chilling security lapse” and expressed concern over the safety of judicial officials.

Key Directions by the Court

NIA to Take Over Investigation
The Supreme Court directed the NIA to fully take charge of the case. The agency will now independently question the suspects already arrested by the state police and continue the investigation. A preliminary report has already been submitted to the Court.

Questions for State Officials
Senior officials of the West Bengal government, including the Chief Secretary, Home Secretary, and Director General of Police (DGP), appeared before the Court through video conferencing. The judges questioned them about their apparent inaction during the long hostage situation.

At the district level, the Malda administration has also taken steps. A show-cause notice has been issued to the Additional District Magistrate (Law & Order) for failing to prevent the incident.

Security Measures and Monitoring

The Court made it clear that central security forces deployed in the state will not be withdrawn at this stage. It stressed that maintaining law and order is a priority.

Additionally, the Court ordered the formation of a new oversight committee consisting of three retired senior judges. This committee will help improve and standardize the functioning of 19 appellate tribunals handling cases related to the Special Intensive Revision (SIR) process.

Progress Despite Violence

Despite the incident, the Court noted that judicial work has continued. Around 59.15 lakh objections have already been resolved across the state out of a total of 60.6 lakh cases. In Malda district alone, about 8 lakh cases have been decided.

Evidence of the Attack

The Court was shown CCTV footage from the night of the incident. The video reportedly shows around 34 motorcycles chasing the vehicles of the judicial officers after they were released from the siege, raising further concerns about their safety.

Court’s Observations

The Supreme Court expressed strong concern over the political situation in the state, calling it highly polarized. It noted that even neutral institutions like the judiciary are being targeted, which is a matter of serious concern.

The matter will be heard again on April 13, 2026, when further updates on the investigation and action taken are expected.
